General Terms of Use (GTU)

Article 1: Preamble

These General Terms of Use (hereinafter referred to as “GTU”) govern the use of the Koulchi Hna website (hereinafter referred to as “the Platform”), accessible at https://koulchihna.ma.
By accessing or using the Platform, the User (as defined in Article 2) acknowledges having read, understood, and accepted these GTU without reservation. Acceptance of the GTU constitutes a legally binding agreement between the User and the Publisher.

Article 2: Definitions

The terms used in these GTU have the following meanings:

  1. Platform: Refers to the Koulchi Hna website and all services accessible through it.
  2. User: Any individual or legal entity using the Platform’s services, whether registered or not.
  3. Provider: Any User offering services or tasks through the Platform.
  4. Requester: Any User seeking or requesting services or tasks through the Platform.
  5. Content: Refers to any information, text, image, video, or other data published by a User on the Platform.
  6. Services: All functionalities offered by the Platform, including the facilitation of connections between Providers and Requesters.
Article 3: Purpose

The purpose of these GTU is to define the conditions under which:

  1. Users access the Platform and use its Services;
  2. Providers and Requesters interact through the Platform;
  3. The rights, obligations, and responsibilities of the parties are established.

The Platform acts solely as a technical intermediary and is not a party to any agreements or contracts concluded between Providers and Requesters.

Article 4: Acceptance of the GTU

The use of the Services is subject to the prior and unconditional acceptance of these GTU. This acceptance is confirmed by checking a box or clicking a button during registration on the Platform.
If the User disagrees with any part of the GTU, they are requested not to use the Platform.

Article 5: Conditions of Access to the Platform
5.1. Registration and Account Creation
  1. Access to certain Platform features is subject to creating a user account.
  2. Registration is open to individuals aged 18 or older or legal entities represented by an authorized agent.
  3. During registration, the User agrees to provide accurate, complete, and up-to-date information.
5.2. Identification and Security
  1. Each User account is strictly personal. The User agrees to keep their login credentials confidential.
  2. Any connection or action performed using the User’s credentials is presumed to have been made by the User.

Article 6: User Obligations

6.1. General Obligations
  1. The User agrees to use the Platform in compliance with Moroccan laws and these GTU.
  2. The User must refrain from any fraudulent or malicious use of the Platform, including but not limited to:
    • Publishing illegal, offensive, or inappropriate content;
    • Requesting prohibited services (see Article 7);
    • Identity theft or document falsification.
6.2. Providers’ Responsibilities
  1. Providers guarantee the accuracy, legality, and compliance of the services they offer through the Platform.
  2. They agree to deliver their services as described and honor any contractual commitments made with Requesters.
6.3. Requesters’ Responsibilities
  1. Requesters agree to seek only lawful services and provide the necessary information for Providers to deliver their services effectively.
Article 7: Permitted and Prohibited Services
7.1. Permitted Services

The Platform allows the publication and search of ads for services compliant with Moroccan legislation, such as:

  • Private lessons and academic support;
  • Domestic services, crafts, and DIY;
  • Childcare or eldercare services.
7.2. Prohibited Services

It is strictly forbidden to offer or request the following services through the Platform:

  1. Activities contrary to Moroccan law, such as:
    • Prostitution, sexual services, or any pornographic content;
    • Fraudulent, illegal activities, or those inciting violence.
  2. Services that violate human dignity, public morality, or third-party rights.
Article 8: Limitation of Liability
8.1. Platform Liability
  1. Koulchi Hna acts solely as a technical intermediary. The Platform does not guarantee the quality, legality, or suitability of the services offered.
  2. The Publisher disclaims all liability for:
    • Disputes between Providers and Requesters;
    • Damages resulting from the use of Services or services performed.
8.2. User Liability

Users are fully responsible for the information they publish and the commitments they make through the Platform.

Article 9: Sanctions and Termination

9.1. Sanctions for Non-Compliance with GTU

In case of a breach of these GTU, Koulchi Hna reserves the right to:

  • Delete any non-compliant content;
  • Suspend or permanently delete the User’s account.
9.2. Voluntary Termination

The User may terminate their account at any time by contacting customer support at support@koulchihna.ma.
